NEWS: Motorcyclist Awarded $44M in Texting Driver Crash Lawsuit
Law 360 reports a motorcyclist in South Carolina won a $44 million verdict against Amazon in a lawsuit alleging a company delivery driver caused an accident due to texting while driving.
Shannon Shaw was hit while driving his motorcycle in Dorchester County, South Carolina by a delivery van operated by an employee of MJV Logistics, LLC – an Amazon delivery service partner. The suit alleges that the delivery driver made an “abrupt left turn at a stop sign, cutting in front of Shaw’s motorcycle, resulting in a crash that caused injuries to his shoulder and spine, along with a mild brain injury.”
“After approximately 4 hours of deliberation, the jury unanimously found that MJV Logistics and/or Blekicki were agents/employees of Amazon,” plaintiff’s counsel said. “This is believed to be one of the first cases in the United States where a jury found Amazon vicariously liable as a principal for the conduct of its DSPs (which Amazon contends are all independent contractors).”
The jury awarded Shaw $11.1 million in economic damages, $3.3 million in noneconomic damages such as pain and suffering, and $30 million in punitive damages against the Amazon defendants, among other awards.
