Timeline for a Personal Injury Claim

When you are injured in an accident, you may be faced with medical expenses and other costs that can make life much more frightening and difficult. This prompts some people to accept settlement offers from an insurance company before they have spoken with an attorney. While this may be a faster option than filing suit, it is also one that can diminish your compensation. We strongly encourage you to speak to one of our lawyers about your rights and your options before you accept an offer from an insurance company.

How Long do Personal Injury Claims Take?

Some personal injury claims are settled within one to two months, but the average length of time it takes to settle a claim is 11 months. A bulk majority of personal injury claims do not go to trial but are instead settled during mediation. When a claim goes to trial, it may take up to two years for a settlement to be reached.

While it is best to take swift action following an accident that results in injury, you do have four years to file a claim in the state of Florida. We encourage you to act more quickly than that, however. The longer you wait to file, the more complicated your claim may become and the more time may pass before you are awarded the compensation you are due.
