Transcript: The Death on the High Seas Act is actually a federal statute. It's under Title 46, which is the Shipping Act of the United States Code.
It's a statute which provides, in certain circumstances, the limited recovery by the family of the now-deceased passenger or crew member. That limitation is very severe.
The limitation is that the family of the passenger or crew member can recover only what we call 'economic damages.' In other words, there's no pain, there's no suffering, there's no loss of the companionship that the family would suffer after the death of a loved one, and so it's a very limiting statute.
