There are times in our lives when we experience life changing events. Some are good, like a graduation or a wedding or the birth of a child. Some are not so good, like a serious injury to our body, a traumatic brain injury, a sexual assault, or a death of a loved one. Good or bad, we remember these life changing events. And if there is ongoing, chronic pain from the injury, we can be reminded of that injury-- and what caused it -- for the rest of our lives.
We as trial lawyers are defined by who we represent and what we can do for our clients, for you. At Hickey Law Firm, I have the honor of representing good, honest people who have suffered life changing injuries as the result of negligence.
One example of that is a cruise ship passenger who at the age of 26 became a quadriplegic because of the negligent event planning of an all -you -can- drink party at a bar on Cozumel. The bar and planners allowed and encouraged people to dive off of a sea wall into the ocean. But it was not deep there. Our client dove in from the wall and hit the top of his head on the bottom. After we filed suit, retained numerous experts including an event planning expert, an aquatics expert, a physician who specializes in the rehabilitation of quadriplegic people, a life care planner and an economist, and after we took numerous depositions in Miami, New York, and Cozumel, Mexico, we settled against the Mexican bar where the injury took place and the American company which planned the event. The settlement was an enormous amount, a life changing amount of money for our client.
Another example of that is the family of an 89 year old woman who was sitting in the passenger seat of a car which was T boned by another car driven by an intern for the multinational corporation Pernod Ricard. Our client suffered a brain bleed which required surgery. She also suffered orthopedic injuries like broken ribs, broken ankle, torn rotator cuff in the shoulder, and herniated discs in her neck and back. Our client died 4 1/2 years later of causes unrelated to the car crash. She died before the trial of her case. So at trial we had only photos of her and accounts of how she was from our client’s daughter, grand daughter, and friend. The verdict of the jury at trial was to award $4.5 Million, all for pain and suffering ($1Million for every year of suffering). That verdict- that is the trial judge’s 41-page order denying the defendants’ motion for new trial- was affirmed by our appellate court in September, 2018. The defendant paid, with interest, over $5 Million.
Another example is the father and 11-year-old son who were scuba diving in the Florida Keys. The commercial dive boat they were diving from backed over them and fractured both of their skulls, the son more severely than the father. The boy was left with right sided partial paralysis. There was only $1Million in insurance coverage. The defendants paid $12 Million.
I have represented numerous rape and sexual assault victims. These include a woman who was physically assaulted and beaten in her own cabin by a crewmember on a cruise ship. In the beating, the cruise passenger passed out. She regained consciousness and was able to run out the door and call for help. That resulted in a settlement of $9 Million.
I represent and have represented people with catastrophic spinal cord injuries resulting in quadriplegia, central pain syndrome, multiple back surgeries, and debilitating chronic pain; traumatic brain injuries, burns requiring extensive and debilitating skin grafts; and orthopedic injuries resulting in multiple surgeries and eventually chronic regional pain syndrome (CRPS, f/k/a reflex sympathetic dystrophy or RSD).

I am Board Certified by The Florida Bar in 2 separate areas, (1) trials and (2) admiralty and maritime law. I am also Board Certified as a trial lawyer by the national organization, the National Board of Trial Advocates. And I am a member of the American Board of Trial Advocates (ABOTA).
I have served as President of the Dade County Bar Association. Currently, I am on the Board of Governors of The Florida Bar (the body which governs all lawyers in Florida under the Supreme Court of Florida) and the Board of Directors of the Florida Justice Association (the statewide organization of trial lawyers in Florida). And I am a state representative, PAC Board of Trustee member, and Chair Elect of the Motor Vehicle and Premises Liability Section of the American Association for Justice (the nationwide organization of trial lawyers).

Our founding attorney John H. (Jack) Hickey has been fighting for personal injury victims for decades.
