Wrongful death is when someone dies as a result of a negligence of a cruise line, railroad, a business. Wrongful death is governed by laws, statutes in the state of Florida, specifically who is a survivor? What kind of damages that the family and the survivors can recover? When a death occurs on a cruise ship or out at sea, there is a Federal statute called The Death on the High Seas Act, which can apply and that does limit recovery quite a bit. The Death on the High Seas Act does not always apply though and it depends upon, believe it or not, where the death actually occurred, that is, where the ship or the boat was when the death took place.
